Terms & Conditions

Last updated: 18 April 2026. These Terms & Conditions govern your use of Order Hand, a software-as-a-service subscription platform operated by Kea Sigma Delta Limited.

By accessing or using Order Hand, you agree to these Terms. If you do not agree, you must not use the service.

1. Use of the service

Order Hand is provided to help businesses manage customer orders, contacts, and related sales workflows. You may use the service only in accordance with these Terms and all applicable laws.

2. Accounts and security

You must provide accurate and current information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account and must notify us promptly through our Contact page if you suspect any unauthorised use.

3. Subscriptions, billing, and cancellation

  • Paid features may require an active subscription.
  • Subscription fees are charged in advance on the billing cycle for your selected plan.
  • We may offer free trials or promotional periods subject to any terms presented at sign-up.
  • You authorise us and our payment providers to process payments for your subscription.
  • Unless otherwise stated, subscriptions renew automatically until cancelled.
  • Upgrades may take effect immediately and may be charged on a prorated basis.
  • Downgrades will normally take effect at the start of the next billing cycle.
  • We may change pricing or plan features from time to time by giving reasonable prior notice, usually at least 30 days before a material change affects your next billing cycle.
  • If payment is overdue, we may retry the payment method and provide a grace period, usually at least 14 days, before suspending or limiting access to the service. Continued non-payment over a longer period may result in termination, with any data retention or deletion handled in accordance with our Privacy Policy and legal obligations.
  • You may cancel future renewals, but fees already paid are generally non-refundable except as required by law or where we expressly state otherwise.

4. Your data and responsibilities

You retain ownership of the business and customer data you enter into Order Hand. You grant us a limited right to host, store, process, transmit, and back up that data as needed to operate and support the service.

We may also derive anonymised and aggregated statistics from service data for service improvement, benchmarking, and business planning. We apply safeguards so these statistics are used only in ways that people and businesses cannot reasonably be identified.

You are responsible for ensuring that you have the lawful right to collect and use any personal information you upload, including names, phone numbers, email addresses, delivery information, and message-related order details.

We will only store, transmit, back up, secure, display, and otherwise process your business data as needed to provide the service to you. We will not have our staff look at it, or use it for any purpose other than providing the service to you, without your permission, unless access or disclosure is required by law. This does not prevent us from creating and using anonymised, aggregated statistics as described above.

5. Acceptable use

You must not use Order Hand to:

  • Break the law or infringe another person’s rights;
  • Store or transmit harmful, abusive, fraudulent, or misleading content;
  • Send spam or unauthorised bulk communications;
  • Upload malware or interfere with the operation or security of the service;
  • Attempt to gain unauthorised access to accounts, systems, or data; or
  • Copy, resell, reverse engineer, or exploit the service except as allowed by law.

6. Third-party services

Some features may rely on third-party providers such as payment, hosting, analytics, or messaging services. Your use of those features may also be subject to the relevant third-party terms and policies.

7. Intellectual property

We or our licensors own all rights, title, and interest in Order Hand, including its software, branding, design, and content, except for data you upload. We grant you a limited, non-exclusive, revocable right to use the service during your active subscription and in accordance with these Terms.

8. Availability and changes

We may update, modify, suspend, or discontinue parts of the service from time to time. While we aim to provide a reliable platform, we do not guarantee uninterrupted or error-free availability.

9. Termination

We may suspend or terminate your access if you breach these Terms, misuse the service, or fail to pay applicable fees. You may stop using the service at any time. Clauses that by their nature should continue after termination will remain in effect.

If your subscription ends or your account is closed, you should export any data you wish to keep before access ends. We may retain service data for a limited period, typically up to 60 days, to allow export, recovery, or account administration, and may then delete or anonymise it, subject to any legal obligations requiring longer retention.

10. Disclaimers

To the maximum extent permitted by law, Order Hand is provided on an “as is” and “as available” basis. We do not warrant that the service will be uninterrupted, secure, or suitable for every business use case.

11. Limitation of liability

To the maximum extent permitted by law, Kea Sigma Delta Limited will not be liable for any indirect, incidental, special, consequential, or loss of profit damages arising out of or relating to your use of Order Hand. Our total aggregate liability arising out of or relating to the service will be limited to the amount you paid for the service in the 12 months immediately preceding the event giving rise to that claim.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

13. Changes to these Terms

We may revise these Terms from time to time by publishing the updated version on this page. Continued use of Order Hand after changes take effect means that you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of New Zealand. Any dispute arising in connection with these Terms or the service will be subject to the non-exclusive jurisdiction of the courts of New Zealand.
